THE ROLE OF THE INSTITUTION OF HISBA IN THE SHARIA IMPLEMENTING STATES IN NORTHERN NIGERIA

Format: MS WORD |  Chapter: 1-5 |  Pages: 65-80 THE ROLE OF THE INSTITUTION OF HISBA IN THE SHARIA IMPLEMENTING STATES IN NORTHERN NIGERIA ABSTRACT This research is concerned with the role Hisba is expected to play regarding Sharia implementation in some states of Northern Nigeria and the extent that the Hisba played the role. Hisba evolved during the time of the Prophet SAW and it developed during the time of the classical Caliphs and later generations particularly the Umayyad and Abbasid dynasties. It was during the Umayyads that Hisba became an independent constitutional agency and this continued up to this moment. The Hisba existed alongside the police, the army as well as the ombudsman institution (Mazalim) throughout Islamic civilization including (lately) the Sokoto Caliphate, where Hisba was not a prominent feature of that government as a Constitutional agency. Sharia was part of Muslim life in Nigeria prior to British colonization which gradually eroded Sharia till it was finally restricted to personal law. In 1999, Zamfara State enacted a Law that enables courts to apply Sharia Criminal law and in 2003 the State established the Hisba with the aim to enhance Sharia implementation in the State and nine other states followed Zamfara, they include Kano and Jigawa. Ten states in Nigeria established Hisba because they thought it was imperative for a proper implementation of Sharia and because it was obvious that Nigeria Police was not willing to implement the provisions of the Sharia Penal Codes. Three out of these ten states enacted laws to establish Hisba as Commission, Board and Committee respectively; they are Zamfara, Kano and Jigawa. In five of the remaining sev HERE IS WHAT OUR HAPPY CLIENTS ARE SAYING

Format: MS WORD |  Chapter: 1-5 |  Pages: 65-80 THE ROLE OF NIGERIA POLICE THE ADMINISTRATION OF ISSUES AND CHALLENGES ABSTRACT Crime has been a major subject of concern throughout human history. No society is free of crime and criminals. The Nigeria Police Force is an agency established by law to ensure preservation of public order and law enforcement as well as prevention and detection of crime. The police plays vital role in the administration of justice in any society. The police present the entry point into the criminal justice system either through reports from the public or its own investigation and surveillance. It is therefore a fact that an average citizen has contact with the police more than with any other agency for administration of criminal justice. This thesis examines the role of Nigeria police in the administration of justice. The main objectives of this thesis are to critically analyse the role of the police in the administration of justice; to identify challenges militating against the police in the areas of crime control and detection. The thesis observes that some legal provisions on the operation and function of police have negatively affected the operational capacity of the police for example, section 214(3) and 4 of the 1999 Constitution of Nigeria just to mention a few. The thesis equally observes that corruption in the Nigeria Police has been exacerbated by poor working conditions, inadequate logistics and working facilities. These have greatly undermined the operational efficiency of the police to prevent and control crime in Nigeria. Consequently, the thesis recommends amongst other things the amendment of section 214(3) of the constitution to effect that a governor of a state being the Chief Security Officer can give lawful directives to the commissioner of police. Similarly, the police must be properly trained, and adequately equipped and well remunerated. The police must also collaborate with other law enforcement agencies sharing intelligence to facilitate crime prevention and detection in Nigeria. HUMAN RIGHTS ABUSES IN THE NIGERIAN PRISON SYSTEM: A CASE STUDY OF NIGER STATE PRISON

Format: MS WORD |  Chapter: 1-5 |  Pages: 65-80   ABSTRACT Prisoners in Nigeria are often perceived and categorized as “outcast”. The belief of many is that, once you are a prisoner, you are automatically a “bad egg” in the society. There is an ill-conceived notion that prison inmates have no rights within the general population. The importance of this research work cannot be over emphasised as it seeks to enlighten the reader of the fact that though there are rights available and at the disposal of prisoners under the Nigerian laws, majority of prisoners, due to one cog or another are unable to have access to and make adequate use of those rights; they are even in most cases unaware of the existence of such rights. This research work shows that there are other abuses going on in our prisons apart from the congestion problem. Such relates to feeding, clothing, bedding, access to health facilities, communication etc. These rights as well as those guaranteed by the Constitution of the Federal Republic of Nigeria, 1999 are very much alive and available to prisoners in Nigeria. The rights may be limited; but prisoners do have a degree of human and civil rights also guaranteed by international conventions and the UN Declarations. Most especially the Standard Minimum Rules for the protection of prisoners. Therefore, prisoners cannot and should not be subjected to cruel and unusual punishment; they are to have full access to due process and equal protection and should not be discriminated against. So this research work, with particular reference to Niger State, to a great extent has been able to: (i) ascertain the extent of prisoners’ rights abuses and its effects on their lives in prisons in Niger State; (ii) determine the factors responsible for the abuses; (iii) examine the measures that need to be taken to incisively and concisely address all problems of prisoners rights abuses. All these have been achieved through thorough research and findings and accordingly, adequate recommendations have been proffered. The doctrinal and empirical methods of research i.e. books, journals and articles as well as administering of questionnaires was adopted to achieve the desired goal of addressing the pervasive violations of prisoners’ rights.
